Terms of use for testers

1. Purpose

These terms of use govern participation in the Avitime testing programme, operated by SPARKMOTION AGENCY LTD (“Avitime”). Registration and participation are free.

2. Registration

  • The programme is reserved for adult individuals, acting in a personal capacity and living in France.
  • Each person may hold only one account, in their own name. A tax number and a phone number can only be linked to one account. Other members of the same household may create their own account; accounts in the same household (same delivery address) share the product limit of the household’s highest grade.
  • The Tester provides accurate information and confirms their email address. Their postal address is only requested at the time of a mission.

3. Admission

Before any application, the Tester completes a profile questionnaire, reads the tester rules and takes a 15-question comprehension test. They certify that they answer alone, without help from artificial intelligence or another person.

  • 13 correct answers or more: eligible. The Tester then accepts these terms.
  • 10 to 12 correct answers: to be completed. A single new attempt is allowed.
  • Fewer than 10, or a second failure: registration not validated. A new test is possible after thirty (30) days.

Cheating on the test leads to the registration being refused.

4. Applications and selection

The Tester applies to campaigns in the catalogue, within a daily number of applications set by their grade. Applying does not guarantee selection. The final selection is made by Avitime, never by the store, according to eligibility, availability and anti-duplicate criteria, then by random draw between comparable profiles.

5. Mission and €0 order

  • The selected Tester confirms the mission and their delivery address within 48 hours.
  • They receive a personal order link, tied to their account, valid only for the planned product, usable only once and for a limited time. They may not pass it on or use it for other items.
  • The product and delivery are free. Avitime never asks a Tester for payment. Any request for payment must be refused and reported.

6. Testing and deadlines

  • Each mission states a recommended usage period, adapted to the product: from a few minutes to about two weeks. The Tester genuinely uses the product for the time needed to judge it, in real situations.
  • The Tester has 21 days from receipt of the product to publish their review.
  • An automatic reminder is sent every 7 days, by email and in their mission.
  • If prevented, they request a reasoned extension before the deadline.
  • In the event of a delivery problem (lost parcel, delay, damaged product), they report it from their mission: the deadline is suspended during the review.

7. Review content

  • The review describes the Tester’s real, personal experience. All ratings from 1 to 5 are accepted.
  • It is explicit and reasoned: it explains why the product suits or not. It is objective and judges the product as it is.
  • It shows the product in use (where, how, for how long) and includes at least one photo. A video is recommended.
  • It contains no copied text, no personal data (phone, address) and no unlawful content.
  • The Tester accepts nothing in return from a store in exchange for a rating and reports any such offer.

8. Artificial intelligence

The Tester writes their review themselves. They may use a tool, including Avitime’s writing aid, to correct spelling or rephrase their own sentences, and always approve the final text. Having the review written by artificial intelligence is prohibited. A review written by artificial intelligence is refused and may lead to exclusion. Avitime carries out checks (product-specific questions, consistency with the order and delivery, detection of copied reviews and abnormal behaviour) and may ask for clarification.

9. The product and tax

The product received belongs to the Tester, whatever their review. No return or payment may be requested, including after a negative review. Defects or damage noticed on receipt are reported from the mission.

Tax. The product is provided in return for the test and the review. Its value may constitute taxable income for the Tester, who alone is responsible for declaring it. As a platform operator, Avitime collects the Tester’s tax identity (name, address, date of birth, tax number) before the first order, reports the value of products received to the tax authorities each year, and sends the Tester, before 31 January, a summary of the past year, also available in “My received products”. 10. Breaches and sanctions

  • Missed deadline: after the 21-day deadline (including extensions) without a published review or granted extension, the tester account is excluded from the programme and no longer receives products.
  • Fraud (invented, copied or AI-written review, multiple accounts, resale of links, false evidence): the review is refused, then suspension or exclusion depending on severity.
  • Every decision is notified with reasons. The Tester may submit observations and lodge an appeal, reviewed by a person. An exclusion is never based solely on the rating given, on a negative review or on a mere report.

11. Grades, XP and reliability

Grades (Bronze, Silver, Gold, Black) determine how many products a Tester can receive: 5 per month in Bronze, 15 per month in Silver, 25 per month in Gold and 2 per day in Black. Testers move up a grade through reviews published on time. XP rewards participation. The reliability score measures compliance with deadlines and rules; it never depends on the rating given or on whether a review is positive. Thresholds are indicative and may change. A new Tester keeps a fair chance of being selected.

12. Rights in reviews and media

The Tester remains the author of their review. By publishing it, they authorise Avitime and the store concerned to display it, with its photos and videos, on the tested product’s page and on the Avitime website, under a pseudonym or their first name, for as long as the product is marketed. They warrant that they are the author of the published media and that these do not show identifiable third parties without their consent. To be validated: duration and scope of the licence

13. General provisions

Personal data. See the privacy policy.

Changes. In the event of a material change to these terms or the rules, new acceptance is requested before the next mission.

Closing the account. The Tester may close their account at any time, after their current missions have ended.
